General Terms and Conditions

The goods covered by these general conditions are offered for sale by V8 Srls, located in Mestrino (PD) Italy, via del Concilio 2, tax code/VAT number 05248180282, hereinafter referred to as the “Supplier”.

With this agreement, the Supplier sells and the Buyer purchases remotely through telematics tools the material and immaterial goods listed and offered for sale on the website www.massimoamarone.it.

The contract between the Supplier and the Buyer is concluded exclusively via the Internet by the Buyer accessing the website www.massimoamarone.it, where, by following the indicated procedures, the Buyer will finalize the purchase of goods for sale on the website www.massimoamarone.it.

The contract entered into between Enoteca Monte Fasolo srl and the Customer is considered concluded upon acceptance of the order issued from the website www.massimoamarone.it. Acceptance is deemed implicit unless otherwise communicated to the Customer by any means. By placing an order in the various ways provided, the Customer declares to have read the information provided during the purchasing procedure and accepts the conditions listed below. The Customer is therefore advised to carefully read these terms of sale and to print or save them on another durable medium accessible to them.

All prices of the products displayed and listed on the website www.massimoamarone.it are expressed in euros and constitute an offer to the public pursuant to Article 1336 of the Civil Code. These prices always include VAT and may be subject to periodic changes without prior notice. Once the order has been placed by the customer, the price cannot be changed by the seller.

Www.massimoamarone.it, guarantees that the products delivered will be identical to those listed and described on the website.

Www.massimoamarone.it  does not sell alcoholic products to minors under 18. The courier will NOT deliver alcoholic products to individuals under 18 and may request an identity document to verify the buyer’s age.

If, for any reason, a part of these terms and conditions were found to be invalid or ineffective, the validity and effectiveness of the remaining terms and conditions will remain fully intact.

By submitting an order, the Buyer makes a purchase proposal for the selected products based on these terms and conditions.

V8 srls is free to accept or reject this proposal.

If the order is not accepted, the customer will be contacted via email or phone.

The General Terms and Conditions may be modified at any time. Any changes and/or new conditions will be effective from the moment of their publication on this page of the website, with an indication of the effective date of the changes, which must be at least 30 days after the publication date. In any case, the user is entitled to the application of the General Terms and other contractual and economic terms in force at the time of placing the order.

Limitations of Liability

• The Supplier assumes no responsibility for service disruptions caused by force majeure if it cannot fulfill the order within the time specified in the contract.

• The Supplier shall not be held liable to the Buyer, except in cases of fraud or gross negligence, for service disruptions or malfunctions related to the use of the Internet outside its control or that of its subcontractors.

• The Supplier will not be responsible for damages, losses, and costs suffered by the Buyer as a result of failure to execute the contract due to causes not attributable to the Supplier. In such cases, the Buyer will be entitled only to a full refund of the amount paid and any additional charges incurred.

• The Supplier assumes no responsibility for any fraudulent or unlawful use of credit cards, checks, or other payment methods by third parties, for the payment of purchased products, provided it proves that it has taken all reasonable precautions based on the best science and experience of the time and in accordance with ordinary diligence.

• In no case can the Buyer be held responsible for delays or errors in payment if they can prove that the payment was made within the times and methods indicated by the Supplier. For matters not expressly addressed in this contract, the rules on distance contracts apply. For disputes, the court of the consumer’s place of residence or domicile is competent.

Delivery

The shipment of products on massimoamarone.it is entrusted to express couriers.
Www.massimoamarone.it will deliver the ordered products to the address you have indicated. The delivery times listed on massimoamarone.it are estimated solely based on availability, normal order processing, and delivery times declared by the carrier.

Orders are prepared and entrusted to couriers by www.massimoamarone.it on weekdays, from Monday to Friday, during office hours, from 9 AM to 6 PM. Normally, the preparation of an order occurs within 48 working hours after receipt. Once the order is handed over to the courier in Italy, you will receive an email with tracking details and instructions. If you haven’t received the email, please check your “spam” folder or contact us.

Warning: If the packaging delivered shows visible signs of damage, it is mandatory to sign the delivery receipt indicating “with reservation” in the appropriate space. Without this step, it is impossible to proceed with a potential refund for the damaged package.

If, during the fulfillment of the order, any unforeseen circumstances arise (delays in order preparation, product shortages, etc.), we will inform you via email or phone about the status of the order.

The Buyer, at the time of payment and delivery, must prove their majority, as according to Italian law (Law No. 189 of November 12, 2012), the sale of alcoholic beverages to minors under 18 is prohibited.

By using this site to purchase alcoholic beverages, the user declares to be of legal age and that the goods are intended for personal consumption and not for resale.

Warning: In case of subsequent charges by the shipper for incorrect address entries and/or absence at the time of delivery, which necessitate address changes, storage, and re-delivery, such costs will be recharged to the customer.

Right of Withdrawal and Free Return of Goods

A user who has purchased products through the www.massimoamarone.it website has the right to withdraw from the purchase contract concluded with www.massimoamarone.it, without any penalty and without providing any reason, within 14 (fourteen) days from the date of conclusion of the contract for services and from the date of receipt of the goods in the case of purchases.

If the Buyer decides to exercise the right of withdrawal, they must notify the Seller by registered mail with return receipt at the address via Del Concilio, 2 – 35035 Mestrino (PD) Italy, or by email at office@massimoamarone.it, provided that such communications are confirmed by sending a registered letter within 48 (forty-eight) hours. The postal office stamp on the receipt issued will be proof of the sending date.

For the exercise of the right of withdrawal, sending the communication may be validly replaced by returning the purchased goods, provided it occurs within the same terms. The date of delivery to the post office or courier will be the reference for both parties.

The return of the goods, in the case of a physical product, must occur no later than 14 (fourteen) days from the date of receipt of the product. In any case, for a full refund of the amount paid, the product must be returned intact and in a normal state of preservation.
The cost of exercising the right of withdrawal as per this article will be borne by the Buyer.

The Supplier will reimburse the full amount paid by the Buyer free of charge within 14 (fourteen) days from receiving the withdrawal notification.
Upon receipt of the communication indicating the Buyer’s exercise of the right of withdrawal, both parties to this contract are released from their respective obligations, except for those provided for in the previous points of this article.

Payment Methods

To make a purchase, simply follow the steps indicated on the website, entering the necessary details to correctly place the order (customer identification details, credit card number and expiration date, selected items).

Confirmation of correct receipt of the order will be sent by email to the email address provided by the user, within a maximum of 24 hours. The email will contain a list of the details entered during the purchase, which should be rechecked by the customer to ensure prompt correction of any errors.

The card details will not be known to us, as they are exclusively provided to the bank. If you make an error in entering your credit card details, the card issuer will notify us of the failure to proceed.
